We, at Omel Bombas e Compressores Ltda. (“Omel”, “Omel Bombas” or “we”), are committed to safeguarding your privacy and protecting your data. The purpose of this document is to clarify what information is collected from users (“You” or “user”) of our websites – https://omel.com.br/ – and respective services, as well as our social networks, and how this data is used.

In order to provide services, Omel, through its website and its applications and systems, the equipment where it is installed or being used and the devices synchronized with it, collects various data and information, aiming, above all, to provide an increasingly better experience for the user. Omel recognizes that your privacy is very important, therefore we take all possible measures to protect it. In this sense, this Privacy Policy (“Policy”) aims to inform you how your information and personal data will be collected, used, shared and stored through our website and respective services. 1. What are the sources of personal data?

The amount and type of information collected by Omel varies depending on your use of our services and communication networks. We will collect different data depending on whether you are visiting our website or consulting Omel services. To make these definitions and differences more accessible, we have segmented the collection of user data into parts so that you can understand what applies specifically to you.

  • Omel Websites. Consumer-facing websites operated by or for Omel including websites that We operate under our own domains/URLs and mini-sites that We maintain on third party social networks such as Facebook (Websites).
  • Omel websites/mobile applications. Consumer-facing websites or mobile applications operated by or for Omel, such as smartphone applications.
  • Ad interactions. Interactions with our ads (for example, if you interact with one or more of our ads on a third-party website, we may receive information about that interaction).
  • Data Created by Us. During our interactions with You, We may create Personal Data about You (for example, but not limited to, records of Your purchases on our websites, and records of Your interactions with our content and/or emails).
  • Events. Events held and organized by Omel, as well as events in which Omel participates as a sponsor or exhibitor.

It is also worth mentioning that we store information about all contacts already made with our users, regardless of the type of user who made the contact. Such information includes content downloaded from our pages and interactions via email, such as opening and clicks.

By clicking on the social media content sharing buttons available on our pages, the user will be publishing the content through their profile on the selected network. Omel does not have access to the user’s login and password on these networks, nor will it publish content on the user’s behalf without the user taking this action.

It is important to note that all data we collect is used to market and promote our products and services, in addition to helping us better serve our customers and users. Therefore, all data and information about you is treated as confidential, and we will only use it for the purposes described herein and authorized by you, always aiming to improve your experience as a user. 1.2. What are the Legal Bases for Data Collection?

We use only legally authorized forms of data collection as the legal basis for collecting data, such as, but not limited to, consent, legitimate interest and the regular execution of contracts entered into. When the legal basis for collection is not consent, we will always observe current legislation and respect the individual rights and freedoms of data subjects.

2. What types of data does Omel collect?

2.1. Website Visitors

If you only access our websites, we will collect your browsing data. In this case, when you visit our website, a “cookie” is inserted into your browser through the software, to identify how many times you return to our address.

“Cookies” are identifiers that we transfer to your browser or device that allow us to recognize your browser or device and tell us how and when pages and features on our Services are visited and by how many people access them.

2.2 Omel Leads

If you interact with our materials and content, we will collect, in addition to your browsing data mentioned in the Visitors section, your visit data to our pages, and other information that you choose to share with us, through your interactions with our forms, Landing Pages and emails, for example.

In order to offer you content and materials that are of interest to you, it is often necessary to cross-reference the data we collect from you, so that our marketing actions are directed to what you expect to receive from us. We guarantee that this cross-referencing is not done in a discriminatory manner, and does not violate any of your individual rights or freedoms. In addition, you can, at any time, change or remove such data processing permissions by contacting us.

2.3. Users of Omel Websites and Services

If you use any of our services and/or products, we will collect, for example, the following categories and types of personal data: contact data (name, email and telephone), location data (country, state and city), professional profile data (position, name and segment of the company where you work, number of employees at that company, academic background and years of experience), billing data (name, CPF, CNPJ, state and municipal registration – when applicable, address, credit card), data for marketing purposes (your marketing preferences and information about your CRM).

For online support and access to website services and/or products, the following are collected:

  • contact details (name, email and telephone)
  • professional profile data (position, company, company segment, number of company employees.

For the acquisition of our services and/or products and access to specific information and costs, the following are collected:

  • contact details (name, email and telephone number);
  • professional profile data (position, company, company segment, number of company employees);
  • location data (country, state and city);
  • billing and collection data (company name or name, trade name, CNPJ or CPF, legal representative and their CPF, address of the headquarters, credit card data, when opting for this payment method, options regarding Simples Nacional, additional data for issuing an Invoice and payment currency for international customers).

2.4. Participants in Omel events

If you participate in an event held by Omel, the data necessary to confirm your registration (such as name, location data, company where you work and place of residence) will be collected through a third-party ticketing platform.

Your email data, collected during our events, will be shared with our Marketing team, in order to send you content and news about topics related to the event proposal. You can request to change these preferences at any time.

3. Who does Omel share your data with?

By using an online platform to better serve you, Omel may operate in conjunction with other companies in a wide range of activities, including to provide location features, advertisers, sponsors and commercial partners, online and offline, as well as dissemination tools and performance analysis. Therefore, we reserve the right to share your information, including location, registration and interest data, with suppliers duly approved by us, whenever possible, anonymously, in order to preserve your privacy as much as possible.

We do not rent, sell or transfer your personal data to anyone except the partner companies listed below. We may share your personal data in the cases mentioned below:

  • Advertisers: You may eventually receive directly advertisements, content and links displayed in a personalized manner by Omel, according to your interests and behavior on our platform or other services with which you interact. For this purpose, data may be shared between Omel and the targeted advertising platform, mainly unique identifiers, IP addresses, cookies and other information collected from your browser, which may be used to measure the efficiency of online advertising. You can always object to this advertising by contacting us.
  • Our Partners: We employ other companies to perform work on our behalf and we need to share your personal data with them to provide products and services to you. For example, we use data hosting services to store our database, and we also use payment method services to process billing data for our products purchased by you. Our Partners are only authorized to use personal data for the specific purposes for which they were hired, therefore, they will not use your personal data for any purposes other than those related to the provision of services provided for in the contract.

  • Social media profiles or other submissions: Registration on Omel platforms may allow the user to register by logging into their account via Facebook or Gmail. In this way, certain data from your Facebook and Gmail account may be shared with Omel. In this sense, when logging in, check the publicly accessible personal data that is authorized by these platforms so that you can decide what you want to share with us or not. We do not control the policies and practices of any other third-party website or service, so if you register using your profile on a social network, please be aware of this.

To safeguard and protect Omel’s rights, we reserve the right to access, read, preserve and disclose any data that we believe is necessary to comply with a legal obligation or a court order and other agreements; or to protect the rights, property or safety of Omel, our employees, our users or others.

4. International Data Transfer

Omel collects and transfers personal data collected in Brazil to countries located in the European Union and to the USA. This transfer occurs to Omel Partners that work on the processing of personal data, and these transfers only involve Omel Partner companies that have demonstrated that they are in the process of complying or in compliance with the GDPR and with Brazilian sectoral data protection laws.

Omel is headquartered in Brazil and the data we collect is governed by Brazilian law. By accessing or using Omel Services or providing personal data to us, you consent to the processing and transfer of such data to Brazil and other countries mentioned above.

5. What are the rights of data subjects?

You can always choose not to disclose your data to us, but please note that some of this data may be required to register on our platforms or use some of the features and products we offer you. Regardless, you will always have rights regarding the privacy and protection of your personal data, and we are not only concerned about the security of this data, but also ensure that you have access to and are aware of all of your rights regarding personal data.

All data collected will be deleted from our servers when you so request or when it is no longer necessary or relevant to provide you with our services, unless there is any other reason for its maintenance, such as a possible legal obligation to retain data or the need to preserve it to protect Omel’s rights. 6. How long will Omel store the data?

We will only retain your personal data for as long as necessary to fulfill the purposes for which we collected it, including for the purposes of complying with any legal or contractual obligations, or requests from competent authorities.

To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorized use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements.

If you use our products and services, your account information will be kept as long as you keep it active. If you request cancellation, your information will be deleted within 30 (thirty) days after the account is cancelled. If you request the deletion of your data and/or your account, in this case, Omel will keep the data for 10 (ten) days after your deletion request.

7. How Information Security works at Omel

Your account is password protected for your privacy and security. If you access your account through a third-party website or service, you may have additional or different login protections through that website or service. You must prevent and avoid unauthorized access by third parties to your account and personal data by selecting and protecting your password and/or other login mechanism appropriately and by limiting access to your computer or device and browser, and by logging out after you have finished accessing your account.

In order to guarantee your privacy and the protection of your personal data, Omel adopts the best information security and secure development practices available on the market, that is, we contract products and services that promote the protection of your data and in which you can manage your information directly.

We strive to protect the privacy of your account and other personal data that we maintain in our records, but unfortunately we cannot guarantee complete security. Unauthorized account entry or use, hardware or software failure, and other factors may compromise the security of your personal data at any time, so it is necessary that you also ensure that we maintain a safe environment for everyone.
